Exo Imaging (“Exo”, we, us, or our) is committed to protecting the privacy and security of personal information entrusted to us. This Privacy Policy (“Policy”) describes how we collect, use, and share information when you interact with us through:
Our website, exo.inc, (the “Site”), which provides information about our organization, services, and programs; and
Our online store (the “Store”), which is hosted and operated in partnership with Shopify and supports online purchases and account management.
Because the Site and Store operate on different platforms and may collect information in distinct ways, this Policy explains how data is handled in each environment. In general, information collected while browsing or submitting forms on our Site is managed directly by Exo. Information collected in connection with purchases or other Store activities is processed through Shopify in accordance with this Policy and Shopify’s own privacy practices.
We encourage you to read this Policy carefully to understand how we manage your information across both the Site and the Store, and the choices available to you.

Changes to This Privacy Policy:
We may update this Policy from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will post the revised Policy on the Site, update the "Last updated" date, and take any other steps required by applicable law.

Information We Obtain from Third Parties
Finally, we may obtain information about you from third parties, including from vendors and service providers who may collect information on our behalf, such as:

  • Vendors and service providers such as event suppliers and organizations we work with, analytics providers, data suppliers, third-party directories, and third parties that provide technical services to us so that we can provide our Site and our Store.
  • Our payment processors, who collect payment information (e.g., bank account, credit or debit card information, billing address) to process your payment in order to fulfill your orders and provide you with products or services you have requested, in order to perform our contract with you.
  • When you visit our Site, open or click on emails we send you, or interact with us or our advertisements, we, or third parties we work with, may automatically collect certain information using online tracking technologies such as pixels, web beacons, software developer kits, third-party libraries, and cookies. Such information may include unique identifiers and a profile of your possible interests and characteristics, which may have been built by observing your activity on websites, apps, and other digital properties, including those operated by third parties, that use our advertising partners’ services.

How We Use Your Personal Information

  • Services and Support. To enable our Site and Store, communicate with you through the Site, provide troubleshooting, technical support, and for similar support purposes, respond to your inquiries, and otherwise fulfil your requests.
  • Analytics and Improvement. To better understand how users access and use the Site and Store, and for other research and analytical purposes, such as to evaluate, develop, and improve our products, services, and business operations, and for internal quality control and training purposes.
  • Communication. To respond to your questions, send you requested materials and newsletters, as well as information and materials regarding our products, services, and our offerings. We may also use this information to send administrative information to you, for example, information regarding the products and services and changes to our terms and policies.
  • Customization and Personalization. To tailor content we may send or display on the Site, Store and/or in providing our products and services.
  • Marketing and Advertising. For marketing, advertising, and promotional purposes. For example, to send you promotional information about our products and services, including information about sales, discounts, and new offerings, as well as any other information that you sign up to receive.

To comply with applicable legal or regulatory obligations, including as part of a judicial proceeding, to respond to a subpoena, warrant, court order, or other legal process, or as part of an investigation or request, whether formal or informal, from law enforcement or a governmental authority.
  • Auditing, Reporting, and Other Internal Operations. To conduct financial, tax and accounting audits, audits and assessments of our operations, including our privacy, security and financial controls, as well as for risk and compliance purposes. We may also use personal information to maintain appropriate business records and enforce our policies and procedures.
  • General Business and Operational Support. To assess and implement mergers, acquisitions, reorganizations, bankruptcies, and other business transactions such as financings, and to administer our business, accounting, auditing, compliance, recordkeeping, and legal functions.

Cookies and Other Tracking Technologies
Like many websites, we use Cookies and other tracking technologies on our Site. A cookie is a small text file that is placed on your hard disk by a Web page server. Cookies help provide additional functionality to the Site or help us analyze usage of the Site more accurately.

For additional information about the cookies that power our Store with Shopify, see https://www.shopify.com/legal/cookies. We use Cookies to power and improve our Site and our Store (including to remember your actions and preferences), to run analytics and better understand user interaction with the Services (in our legitimate interests to administer, improve, and optimize the Services). We may also permit third parties and service providers to use Cookies on our Site to better tailor the services, products, and advertising on our Site and other websites.
Most browsers automatically accept Cookies by default, but you can choose to opt-out of certain cookies when you set your browser to remove or reject Cookies through your browser controls. Please keep in mind that removing or blocking Cookies can negatively impact your user experience and may cause some of the Services, including certain features and general functionality, to work incorrectly or no longer be available. Additionally, blocking Cookies may not completely prevent how we share information with third parties, such as our advertising partners.
Our Site also recognizes the Global Privacy Control (GPC) signal, which enables you to opt-out of certain uses or disclosures of your information. If you notify us of your preference through GPC, we will treat such signal as a valid request to opt out of sharing / targeted advertising for the associated browser or device, and, if we are able to associate the device sending the signal to a Shopify account, we will apply the opt out request to the account as well. Other than the Global Privacy Control, we do not recognize other “Do Not Track” signals that may be sent from your web browser or device.

How We Disclose Personal Information
We will not disclose your personal information to third parties other than as described in this Policy unless we have your permission or are required or permitted to do so by law. We may share such information with our affiliates as necessary to carry out the purposes for which the information was supplied or collected. Similarly, third-party contractors, consultants, and/or vendors engaged by us to provide services may have access to your personal information. These third parties will be subject to their own data protection requirements, providing the same or greater level of security provided by us, and in most instances will also have entered into a written agreement with us that addresses access to and use of your personal information.
We may disclose the personal information we collect for the purposes described above with third parties as follows:

  • To vendors or other third parties who perform services on our behalf (e.g., IT management, payment processing, data analytics, customer support, cloud storage, fulfillment, and shipping).
  • To business and marketing partners to provide services and advertise to you. Our business and marketing partners will use your information in accordance with their own privacy notices.
  • When you direct, request us or otherwise consent to our disclosure of certain information to third parties, such as to ship you products or through your use of social media widgets or login integrations, with your consent.
  • To our affiliates or otherwise within our corporate group, in our legitimate interests to run a successful business.
  • In connection with a business transaction such as a merger or bankruptcy, to comply with any applicable legal obligations (including to respond to subpoenas, search warrants and similar requests), to enforce any applicable terms of service, and to protect or defend Exo, the Site, our rights, and the rights of our users or others.
  • Notwithstanding anything else in this Policy, we may use, disclose, and otherwise process aggregate and deidentified information related to our business, the Site or the Store with third parties for quality control, analytics, research, development, and other purposes.
  • We may disclose personal information in other ways not described above, but will notify you and, if necessary, obtain your consent.
    We do not use or disclose sensitive personal information without your consent or for the purposes of inferring characteristics about you.

Your Privacy Rights
Depending on where you live, you may have some or all of the rights listed below in relation to your personal information. However, these rights are not absolute, may apply only in certain circumstances and, in certain cases, we may decline your request as permitted by law.

  • Right to Access / Know: You may have a right to request access to personal information that we hold about you, including details relating to the ways in which we use and share your information.
  • Right to Delete: You may have a right to request that we delete personal information we maintain about you.
  • Right to Correct: You may have a right to request that we correct inaccurate personal information we maintain about you.
  • Right of Portability: You may have a right to receive a copy of the personal information we hold about you and to request that we transfer it to a third party, in certain circumstances and with certain exceptions.
  • Restriction of Processing: You may have the right to ask us to stop or restrict our processing of personal information.
  • Withdrawal of Consent: Where we rely on consent to process your personal information, you may have the right to withdraw this consent.
    You may exercise any of these rights where indicated on our Site or by contacting us using the contact details provided below.
    We will not discriminate against you for exercising any of these rights. We may need to collect information from you to verify your identity, such as your email address or account information, before providing a substantive response to the request. In accordance with applicable laws, you may designate an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us. We will respond to your request in a timely manner as required under applicable law.

    Explicit Notice – Right to opt-out
    We and our advertising partners collect personal information (such as Usage Data) when you use our Site. We, and our advertising partners, may use this information to personalize the ads we deliver to you when you visit others’ sites or use others’ apps. To personalize the ads so that they may be more relevant to you, our advertising partners may share personal data with other third parties.
    If you do not wish for us or our advertising partners to use and disclose your personal data in this manner, which may be considered a “sale” under applicable U.S. state privacy laws, select the applicable control from our Cookie Notice.
    If you access our Site or Store from other devices or browsers, visit the link below from those devices or browsers to ensure your choice applies to the data collected when you use those devices or browsers. If you use different browsers, devices or platforms, you will need to opt out on each browser, device or platform.
    Additionally, although our Cookie Notice. will let you opt out of the sale of your personal information for advertising purposes, it will not opt you out of the use of previously collected and sold personal information or all context-based advertising.
    Managing Communication Preferences: We may send you promotional emails, and you may opt out of receiving these at any time by using the unsubscribe option displayed in our emails to you. If you opt out, we may still send you non-promotional emails, such as those about your account or orders that you have made.

How We Secure Personal Information
We are committed to keeping personal information secure and we have implemented information security policies, rules and technical measures to protect personal information under our control from unauthorised access, improper use or disclosure, unauthorized modification and unlawful destruction or accidental loss. In addition, our personnel and data processors (third parties that process personal data on our behalf) are obliged to respect the confidentiality of the personal information relating to users of our Site and those who purchase our products and services.

How Long We Keep Personal Information
We will only keep your personal information for as long as necessary for the purposes set out in this Policy. We will retain and use your personal information to the extent necessary to comply with our legal obligations for example, if we are required to retain your data to comply with applicable laws, resolve disputes, and enforce our legal agreements and policies.
If any personal information is only useful for a short period (e.g. for a specific activity, promotion or marketing campaign), we will not retain it for longer than the period for which it is used by us.
If you have opted out of receiving marketing communications from us, we will need to retain certain personal information on a suppression list indefinitely so that we know not to send you further marketing communications in the future. However, we will not use this personal information to send you further marketing unless you subsequently opt back in to receive such marketing.

Our Site may provide links to websites or other online platforms operated by third parties. If you follow links to sites not affiliated or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on these sites.

Children's Data
The Site, Store and our products and services are not intended to be used by persons under the age of 18, and we do not knowingly collect any such personal information. If you are the parent or guardian of a minor (under age 18) who has provided us with their personal information, you may contact us using the contact details set out below to request that it be deleted.
